• Subject Matter of the Agreement
This agreement is made to regulate the format of the business activities made through www.agne.com.tr or any other method owned by Agne Tours, Ali Tur Turizm Otelcilik Sanayii ve Ticaret Ltd. Şti. (will be referred as “Agne Tours” from now on”) which is located at Tahıl Pazarı Mah. Adnan Menderes Bulvarı Beyazsaray Apt. No:27/2 Antalya / TÜRKİYE. This agreement is made to protect both Agne Tours and any individual who shop on www.agne.com.tr ( will be referred as “customer” from now on). Any reservation and purchase of a product made via Agne Tours’s website is made under the terms of this agreement.
• Approval of the Agreement
User who wants to shop on Agne Tours website should be a contractual customer. Customer agrees to obey these terms and conditions by filling out a form and accepting Agne Tours Customer Contract. Those who is engaged with the contract to become an Agne Tours customer have to be over 18 years old.
• AGNE TOURS Customer System
a) The customer is obligated to register an e-mail address with a chosen password, and fill out the registration form with required data correctly.
b) Providing correct data and the protection of the password is the customer's responsiblity.
AGNE TOURS is not responsible of unauthorized third party users.
c) Only the registered user knows the password. The user may change his/her passoword anytime he/she wants. It is the user’s responsibility to determine a password. Agne TOURS is not responsible for password usage issues.
• Customer’s Responsibilities
Customer AGREES to be bound with these terms while benefiting from AGNE TOURS services:
a) Information provided for the registration form is correct, and he/she is responsible for any loss caused by an incorrect or missing data (e.g lost password) and customership may end in such cases
b) AGNE TOURS cannot be held responsible for any data or file that is taken incorrectly, gets lost or is sent to a wrong address while its services are being used.
c) He / She may not try to use AGNE TOURS services unauthorized and not change any content, and not use any content that is changed. In such cases, he / she is responsible of any financial and material loss of AGNE TOURS.
d)AGNE TOURS cannot be held responsible for any loss caused by unauthorized access to customer data.
e)Customer is fully responsible for any activity made under his/her e-mail address and password.
f)Customer needs a valid credit card to shop on this website and can not purchase services if his/her credit card’s validity is not confirmed.
g) Customer may be asked to provide a proof of identification and has to let the ID data to be recorded and sign required fields; if not, AGNE TOURS may not deliver the product.
• AGNE TOURS' Responsibilities;
a) AGNE TOURS may link the customer to another websited and the customer agrees that AGNE TOURS is not responsible of the content of these web pages.
b) Services that are used without a contract may be transformed into a contractual service by AGNE TOURS.
c) AGNE TOURS may modify its services partly or as a whole, run additional services, turn free services into paid services.
• Transporter’s Rules;
Agne Tours benefits from its partner airlines’ services while ticketing flight reservations. Passengers who travel with these tickets are bound by these airlines’ terms and policies. Customer agrees to these terms while buying a ticket and can not recourse against AGNE TOURS.
• Extraordinary and Compelling Conditions;
AGNE TOURS is an intermediary between customers and airlines, hotels, organization companies. AGNE TOURS is not responsible for any financial and mental loss caused by accidents, overbooking, delays of cars, busses, ships, trains; wheather conditions, civil commotions, strikes; extraordinary and compelling conditions contrary to agreements between AGNE TOURS and these transporter companies.
• Inappropriate Manners;
a) Acting against the law or violating our rules and “banned content” policies;
b) Providing incorrect and misleading information;
c) Violating the rights of a third party individual;
d) Mail bombardment; sending out mail chains or pyramid schemes;
e) Sending out viruses or other technologies which may violate the rights or properties of Agne Tours and its members;
f) Overstraining our infrastructure and not letting Agne Tours to work properly.
g) Copying, modifying, processing or giving out other users’ information;
h) Collecting information (including electronic mail addresses) of other people without their permission;
i) To omit rules which restricts or prevents login to Agne Tours.
You have to stay away from these inappropriate behaviours.
• Personal and non-commercial use restriction;
Customer agrees that all purchases are done for personal use and not for resale.
• Taxing;
Any legal modification that is not covered within this agreement is not AGNE TOURS’ responsibility and will be reflected to this agreement.
• Product Delivery;
a) A ticket purchased by a customer is delivered to the customer either in person,by electronic mail via this website or to a person which is authorized by the customer.
b) Customer is obliged to receive his/her purchased product under the terms of this agreement. If the customer do not receive the product or receives it late; he / she is responsible to AGNE TOURS and other related companies of the cost of the product or any other loss
• Refunds;
Consumer protection law is not valid for refunds. Refund policies of the companies concerned are valid for refunds.
• Validity of Agne Tours Records;
Customers agree, in advance, on the terms that AGNE TOURS records, microfilms, micro-vouchers and computer records will be held valid, binding and appropriate proof and they declare and pledge that they abdicate their right to object or disapprove any of AGNE TOURS records at all conflicts related to this agreement.
• Applied Rules;
Terms of this agreement are applied for any disagreement about this policy. If no agreement is determined, than the Republic of Turkey Laws are applied.
• Authorized Courts and Directorate of Execution
Antalya Courts of Law and Directorates of Debt and Bankruptcy are authorized at all conflicts related to the hereby agreement.
• Validity
As soon as the user fills out the registration form, benefits from a service or orders a product, this agreement becomes effective between both sides and not limited by time
• GENERAL TERMS;
• Agne Tours is an agency between customers and accomodations. Agne Tours suggests its partner companies to abide by the declared schedule and quality. Agne Tours is not responsible for any trouble.
• Daily excursions are operated if the minimum number of participants is met. Agne Tours has the right to cancel an excursion or change its departure time, vehicle, accomodation options or join it to another company’s excursion if the minimum number is not met or any compelling condition occurs. There may be a price difference caused by these changes. This difference is charged from the customer.
• Agne Tours’ website contains details of services, daily excursions, weekly excursions, rental cars, flights, hotels, discounts, deals and quotas. Customer books at his / her own will. The correctness of the content of Agne Tours website is important to Agne Tours, however Agne Tours is not responsible if the purchased or claimed service is booked out or do not met the announced quality.
• Agne Tours cannot be held responsible of any incidence caused by an extraordinary and compelling condition, natural disaster or anything out of Agne Tours’ will.
• Pension types, hotel concepts, attributed stars vary from facility to facility and from country to country. Customer needs to be aware of these circumstances.
• Airport tax and visa fee, if needed, is collected separately.
• Other than the announced accomodation type; extra food and drinks purchased at a hotel or an excursion, private spendings, out-of-programme services will be paid by the customer.
• Customer is responsible for any tax, fee and expense that is taken from tourists while visiting another country.
• Children discount differs from facility to facility. Discounts are applied if a child stays with his / her parents in the same room as a 3rd or a 4th person.
• Agne Tours is not responsible for any defects, accidents, losses and related damages, additional expenses and obligations caused by or at the vehicles of transportation, accommodation facilities and touring places, not in private nor with the establishments of transportation or accomodation, whatever the source and reasons may be.
• Agne Tours is not responsible if the passenger can not get a visa for any reason. Agne Tours cannot be held responsible if the passenger cannot get a visa due to lateness, missing documents, or the consulate denies in its own initiative.
• Customer may be charged the whole amount Agne Tours is billed or a part of it if he/ she does not show up at the hotel or use the froduct for any reason.
• The departure times of the scheduled flight, ship or train travels are set according to their official local times. Agne Tours cannot be held responsible of the results of time differences.
• Agne Tours customers may purchase an optional personal accident insurance or travel insurance to be protected against accidents which may end up with death or permanent disability.
• Customers agree and undertake that Agne Tours has no responsibilities if no insurance is purchased from Agne Tours.
• Customer has to have his/her passport and ID while travelling. Customer is responsible for any delay or cancellation caused by this reason.
• Agne Tours cannot be held responsible of any damage to luggages caused by a third party individual, on purpose or not, at a flight, transfer, blue cruise,car rental or accomodation facilities.
• TURSAB Arbitration Tribunal is authorized for any disagreement over this agreement and their procedure applies. Agne Tours’ records are valid and used in case of a conflict.
• CANCELLATION and MODIFICATION TERMS
• AGNE TOURS should be contacted on every stage of a purchase through Agne Tours. Othervise, Agne Tours is not responsible for any modification, cancellation, new reservation or any other service that customer makes by himself / herself.
• Agne Tours reserves the right to charge €100 in case of a cancellation of a service ( e.g domestic-non domestic hotel, excursion, visa) that is purchased from Agne Tours, regardless of the date of the reservation. Agne Tours reserves the right to charge the credit card commission from the customer if the service is paid by credit card.
• Check-out requests before accomodation or beginning of the excursion sign up is conditional upon approval from considered hotel / excursion company. No request or appeal may be pointed at Agne Tours since whether a customer can get a refund upon early checkout or not is on the initiative of the hotel / intermediary companies.
• In case of an an early check-out , customer agrees to pay the total amount that Agne Tours paid the hotel.
• If the cancelled ticket is a flight ticket, fines and terms of the airline company concerned are applied.
• Agne Tours reserves the right to not refund 25% of the total amount for cancellations made 30 days before the option time, 50% of the total amount if cancellation is made 30-15 days before the option time, and the whole amount if the cancellation is made 15-7 days before the option time or the customer does not show up at the hotel without prior notice.
• Cancellation claims are evaluated if Agne Tours is informed not less than 14 days before the starting date of the service.
• Agne Tours cannot be held responsible if a demand of change or cancellation is failed, since these are on the initiative of the intermediary companies.
• Agne Tours reserves the right to charge an extra amount if more than two cancellation is made.
• Agne Tours contains data that belongs to us, you and other users. By agreeing this policy, you undertake not to use, copy, modify, distribute our copyrighted and registered trademarks. By submitting us your content; you agree to give us free, permanent, non returnable, transferable, worldwide rights to publish and use it. You need to give us the right to present and publish your content on our website. Click agne@agne.com.tr and contact our representative if you think your rights are violated, and we will investigate it. We reserve the right to modify or change the content concerned, if we think our terms or somebody else’s rights are being violated.
• You undertake that you will not hold us responsible for documents sent by other users and their actions. Since most of this website’s content belongs to other users, we can not guarantee that the content provided by other users is correct, legal and safe. We also can not guarantee safe and constant access to our services. According to this, all kinds of warranties and terms are invalid, as long as laws are anticipated. Agne Tours cannot be held responsible of any financial loss, loss of publicity, direct or indirect damages caused by using Agne Tours. Since some spheres of jurisdiction do not cover these warranties, cautions and restrictions about damages, these restrictions may not be valid for you.
• These are our responsibilities to you or to a third party if it is decided that we are responsible for your loss, even though the last paragraph was agreed:
(a) total amount you paid us in last 12 months before the situation occured or;
(b) limited to 10 Euros. ( whichever is more )
• By using Agne Tours services, you agree that your personal data is transfered, saved and used on Agne Tours’ servers under the terms of our Privacy Policy. In addition, you agree to receive commercial and marketing messages from us, unless otherwise specified.
• It is prohibited to duplicate, distribute, save any content and visual image from the website without Agne Tours’ permission. You will face legal actions if contrary is proved. Please contact us via agne@agne.com.tr in such cases.
• These terms and other principles are considered as a final treaty ( that exceeds all other treaties) between you and us. If one of these terms are invalidated by a court order, the rest is still valid. We may modify the agreement unilaterally in accordance with a declared provision. Please send us the link of any illegal content or any content that violates personal rights. Any other agreement, other than this agreement and any other written agreement signed by us and our customers, is not valid.
